Free Account Terms

These Free Account Terms ("Terms") govern your access to and use of the Real Talk Studio platform (the "Platform") on a free, trial basis. They form a legally binding agreement between you and Toby Sinclair Coaching Limited (company number 15722676), trading as Real Talk Studio ("RealTalk", "we", "us", "our"), registered at 13 Highfield Road, Croston, Lancashire, PR26 9HH.

By creating a free account, you confirm that you have read and agree to these Terms. If you do not agree, you must not create an account or use the Platform.

Please note: If your organisation subsequently enters into a commercial arrangement with RealTalk, these Terms will be superseded in full by the Real Talk Studio Subscription Agreement from the date that agreement comes into force. Your continued use of the Platform after that point is governed by the Subscription Agreement, not these Terms.

1. Who Can Create a Free Account

Free accounts are available to individuals who wish to evaluate the Platform, whether acting in a personal capacity or on behalf of an organisation. You must be at least 18 years old and legally capable of entering into a binding contract.

If you are signing up on behalf of an organisation, you confirm that you have authority to bind that organisation to these Terms, or alternatively that you are acting in a personal capacity as an individual evaluator and your organisation is not itself a party to these Terms.

Note: This distinction matters. If you later convert to a commercial agreement on behalf of your organisation, the organisation — not you personally — becomes the Customer under the Subscription Agreement.

2. What the Free Account Includes

A free account gives you access to a limited set of Platform features for evaluation purposes only. Specifically:

  • You may create and run a limited number of Roleplays using your Credits allocation (as specified on the Platform at the time of sign-up)
  • You may explore the Account Dashboard and Admin User functionality
  • You will have access to sample Output Data including scores and feedback

Free accounts do not include access to enterprise features, custom Roleplay design, dedicated support, or the full Evidence Locker functionality. These are available under a commercial Subscription Agreement only.

We reserve the right to modify what is included in the free account at any time. We will provide reasonable notice of any material reduction in free account features via email or an in-platform notification.

3. Duration and Termination

Your free account remains active until one of the following occurs:

  • You delete your account
  • You enter into a Subscription Agreement with RealTalk, at which point these Terms are superseded
  • Your account is inactive for six months or more (meaning no Roleplay activity), at which point we may deactivate and delete your account and all associated data
  • We terminate your account in accordance with clause 9 (Acceptable Use) or for any other legitimate reason, on reasonable written notice

You may delete your account at any time by emailing toby@realtalkstudio.com. On deletion or deactivation, all data associated with your free account will be permanently deleted within 30 days.

4. Converting to a Commercial Agreement

If you or your organisation wish to move to a paid subscription following your evaluation, you will need to enter into a separate Subscription Agreement with RealTalk. These Terms do not automatically convert into a commercial agreement and no commercial obligations arise from your use of a free account alone.

When a Subscription Agreement is entered into:

  • These Terms cease to apply from the commencement date of the Subscription Agreement
  • Data created during your free trial period may, at your request, be retained and carried over into your commercial account — but this is not automatic. You should request this explicitly at the point of conversion
  • If no such request is made, free trial data will be treated as separate and may be deleted in accordance with clause 3 above
  • Any content, Roleplays, or Concepts created during the trial remain your intellectual property and will not be used by RealTalk beyond the purposes described in these Terms

Note: If you trialled the Platform using a personal email address but your organisation is the commercial customer, you should discuss data continuity with us at the point of conversion so we can ensure the right data sits with the right account.

5. Data Protection and Privacy

5.1 Your role

When you use the free account, you are responsible for any personal data you input into the Platform. This includes ensuring you have a lawful basis to use that data in connection with the Platform and that doing so complies with the UK GDPR and any other applicable data protection law.

We strongly recommend that free account users do not input real personal data about third parties (for example, real employee names or actual workplace conversations) during evaluation. The Platform is designed to operate effectively using fictional scenarios and placeholder information.

5.2 Our role

In the context of free accounts, RealTalk acts as a data controller in respect of account registration data (your name and email address), and as a data processor in respect of any personal data you choose to input into the Platform during your evaluation.

We process your data in accordance with our Privacy Policy, available at realtalkstudio.com/policies/privacy.

5.3 AI Providers

The Platform uses third-party AI Providers to power Roleplay simulations and generate feedback. Any content you input during a Roleplay session may be processed by these AI Providers as part of delivering the Platform's functionality.

RealTalk contractually requires all AI Providers to have model training disabled in respect of any data input via the Platform. Your data — whether input during a free trial or a paid subscription — is not used to train AI models.

5.4 Retention

Data associated with your free account is retained for as long as your account is active. On account deletion or deactivation (including due to inactivity), all associated data will be permanently deleted within 30 days, unless you have converted to a commercial account and requested data continuity as described in clause 4.

6. Intellectual Property

You retain ownership of all content, Concepts, and data you create or input during your free account use. You grant RealTalk a limited licence to process this content solely for the purpose of delivering the Platform's functionality during your trial period.

RealTalk retains all intellectual property rights in the Platform, including its underlying technology, AI architecture, and interface design. Your free account does not grant you any ownership of or rights in the Platform beyond the limited right to use it for evaluation purposes under these Terms.

Output Data generated during your trial (scores, transcripts, feedback) is yours. We do not claim any rights in it.

7. No AI Model Training

For the avoidance of doubt: RealTalk does not use any data input by free account users to train AI models. This applies to conversation transcripts, Roleplay content, and any other data processed via the Platform during your trial. This commitment applies equally to free and paid accounts.

8. Warranties and Limitation of Liability

The Platform is provided on a free, "as is" and "as available" basis during the trial period. RealTalk makes no warranty that the Platform will be error-free, uninterrupted, or suitable for any particular purpose during your evaluation.

To the fullest extent permitted by law, RealTalk's liability to you in connection with your free account use is limited as follows:

  • We do not exclude liability for death or personal injury caused by our negligence, fraud, or fraudulent misrepresentation, or any other liability that cannot be excluded by law
  • Subject to the above, our total liability to you in connection with your free account use shall not exceed £100
  • We are not liable for any indirect, consequential, or special losses, loss of data, loss of profits, or business interruption arising from your use of the free account

You are responsible for any loss or damage we suffer as a result of your breach of these Terms or your unlawful or inappropriate use of the Platform.

9. Acceptable Use

Your use of the free account is subject to the following restrictions. You must not:

  • Use the Platform for any purpose other than evaluating it for potential commercial use
  • Input special category data (as defined under the UK GDPR) into the Platform
  • Input real personal data about third parties without their knowledge and a lawful basis for doing so
  • Attempt to reverse engineer, copy, or reproduce any aspect of the Platform
  • Share your account credentials with others
  • Use the Platform in a way that is unlawful, harmful, defamatory, or that infringes any third party's rights
  • Use the Platform to scrape data, build competing products, or conduct automated data extraction

We reserve the right to suspend or terminate a free account immediately and without notice if we reasonably believe these restrictions have been breached.

10. Confidentiality

By using the free account, you may gain access to information about the Platform's functionality, features, and roadmap that is not publicly available. You agree to keep such information confidential and not to disclose it to third parties without our prior written consent.

11. Changes to These Terms

We may update these Terms from time to time. We will notify you of any material changes by email or via an in-platform notification before the changes take effect. Your continued use of the free account after notification constitutes acceptance of the updated Terms. If you do not agree to the changes, you may delete your account at any time.

12. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
